Terms of service

Who we are, and what you're agreeing to

Locum (the website at locum.now and the Locum mobile app) is operated by ARISDY LIMITED, a New Zealand company (company number 9395605, NZBN 9429053354464), registered office at 24F Mount Smart Road, Royal Oak, Auckland, New Zealand (“ARISDY”, “we”, “us”).

By creating an account or using Locum you agree to these terms and to our privacy policy, which forms part of them. If you use Locum on behalf of an organisation, you confirm you have authority to bind that organisation, and “you” includes it.

The service

Locum is an operations platform for locum work: employers post shifts and roles, locums discover and apply for them, the parties chat, make and accept offers, and keep a shared record of what was agreed; locums also use Locum to run the rest of their working week — calendars, shift-day briefings, documents, and invoicing, including invoices for work arranged outside the platform.

The locum side of Locum is free. Employer features are paid, by subscription, and may be available only in selected regions at any given time.

Locum is a tool, not a party: we are not an employment agency, not the employer of any locum, and not a party to any engagement arranged through the platform. Nothing in these terms or in the operation of the service creates an employment, agency, partnership, or joint-venture relationship between ARISDY and any user, or between ARISDY and either side of an engagement.

Accounts and eligibility

You must be at least 18 to use Locum. You sign in with Google or Apple; keep those accounts secure, because you are responsible for activity under your Locum account. Keep your details accurate — including, for locums, your professional details: you must hold the registrations and qualifications you represent yourself as holding.

Locums

Your profile, documents, and applications must be truthful. Invoices generated through Locum are created and delivered on your instruction, using your figures: you are responsible for their accuracy and for your own tax position, including whether and how GST applies to you. Locum is not an accountant and nothing in the product is tax advice.

Employers

Postings must accurately describe the role, rate, times, and place of work. You remain fully responsible for the engagement itself: the terms you agree with a locum, payment for work performed, and your legal obligations as the operator of a workplace. Where we ask for verification details about your organisation, you agree to cooperate honestly.

A bridge, not a mediator

Locum connects the parties, records what they agree, and delivers invoices. It does not handle money between an employer and a locum, does not take a cut of what changes hands, and does not mediate, arbitrate, or resolve disputes between the parties — including no-shows, hours worked, rates, payment, or quality concerns. Those matters are strictly between the employer and the locum.

What the platform does provide is the record: offers, acceptances, changes, cancellations, and invoice delivery events are timestamped and shown to both sides. An accepted offer is a record of the parties’ commitment to each other — not a contract with ARISDY, and not a guarantee by ARISDY that either side will perform. If a sealed shift is cancelled, we notify the affected party; any consequences of the cancellation are between the parties.

Documents are yours; checks are the employer's

The document library stores and shares files on the owner’s instruction. We do not verify the authenticity or currency of any document, registration, or qualification, and a document’s presence on Locum is not an endorsement. Employers must carry out their own credential and registration checks before engaging any professional, exactly as they would off-platform.

Employer billing

Employer subscriptions and credit top-ups are billed through Stripe at the prices shown at the time of purchase, plus applicable taxes (GST is calculated at checkout). Credits and allowances accrue and expire as described on the billing page for your plan. We may change plans and pricing with reasonable advance notice; changes apply from your next billing period. Except where the law requires otherwise, payments are non-refundable — if something has gone wrong, contact us and we will put it right where that is the fair outcome.

Acceptable use

Use Locum lawfully and in good faith. In particular, you must not: scrape, harvest, or bulk-extract the locum pool or any platform data; misrepresent who you are, who you act for, or what you are qualified to do; post shifts, roles, rates, or credentials that are false or misleading; use chat, invoicing, or notifications to spam or harass; probe, overload, or interfere with the security or operation of the service; or attempt to access another user’s or organisation’s data.

You keep ownership of the content you put on Locum. You grant ARISDY the licence needed to host, process, transmit, and display that content for the purpose of operating the service — an invoice is rendered and emailed, a briefing is cached to a device for offline use, a profile is shown to an employer you applied to. We may remove content or postings that breach these terms.

Suspension and ending your account

You can deactivate or delete your account at any time from within the app (deletion has a 30-day reactivation window, described in the privacy policy). We may suspend, limit, or terminate an account that breaches these terms, poses a security or legal risk, or has fallen into non-payment (for paid employer accounts) — proportionately, and with notice where practicable. Provisions that by their nature should survive (retention obligations, liability limits, disputes) survive the end of an account.

Availability and changes to the service

Locum is provided “as is” and “as available”: we do not promise uninterrupted or error-free operation, and we do not offer a service-level agreement. We are a live product; features will change, improve, and occasionally be withdrawn. If we discontinue a material part of the service, we will give reasonable notice.

Liability

To the maximum extent permitted by law: we are not liable for the conduct of any employer or locum, for the accuracy of what users post, for the outcome of any engagement arranged through Locum, or for indirect or consequential loss (including lost profits or lost data). Our total aggregate liability to you is capped, for paid employer accounts, at the fees you paid us in the twelve months before the event giving rise to the claim, and for free use, at NZD 100.

Nothing in these terms excludes rights that cannot lawfully be excluded. If you acquire the service for business purposes, you agree the New Zealand Consumer Guarantees Act 1993 does not apply, and that both parties contract out of sections 9, 12A, and 13 of the Fair Trading Act 1986 to the extent permitted, it being fair and reasonable to do so. For Australian users, nothing here excludes non-excludable guarantees under the Australian Consumer Law; where liability for their breach can lawfully be limited, it is limited to re-supply of the service.

Indemnity (business users)

If you use Locum in trade — as an employer or as a locum operating a business — you indemnify ARISDY against third-party claims arising from your content, your postings, your engagement terms, or your breach of these terms, except to the extent we caused the loss.

Changes to these terms

We may update these terms from time to time. For material changes we will give notice in the app or by email before they take effect; continuing to use Locum after that means you accept the revised terms. The date at the top of this page always reflects the current version.

General

If part of these terms is found unenforceable, the rest stands. A failure to enforce a right is not a waiver of it. You may not transfer your agreement with us without our consent; we may transfer ours as part of a business sale or reorganisation, on notice and without reducing your rights. Notices from us come via the app or the email on your account. These terms and the privacy policy are the entire agreement between you and ARISDY about the service.

Governing law

These terms are governed by the laws of New Zealand, and the courts of New Zealand have exclusive jurisdiction over any dispute relating to them or to the service — without limiting any non-excludable consumer rights you hold in your own country.
